Courts have recognized O&G's attorneys' WARN Act expertise, and have appointed them class counsel in over 75 WARN Act class actions. They have litigated well over 100 WARN class actions, including in the U.S. Supreme Court and lower federal courts across the country.

In 2017, Outten & Golden achieved a United States Supreme Court 6-2 decision in favor of its WARN Act class. The Court held that bankruptcy courts cannot skip over priority claimants such a WARN Act class, as had occurred in that case. Czyzewski v. Jevic Holding Corp., 137 S. Ct. 973 (2017).

The WARN Practice Group has obtained influential decisions that allow WARN Act class actions to be litigated in bankruptcy proceedings. It is has won reversals of lower court decisions in two federal Circuit Courts of Appeal.
