UPDATE 4/3/12

On January 25, 2012, Outten & Golden filed suit against TSC Group, LLC, d/b/a TSC Global to recover 60 days wages and benefits for former employees of TSC Global under the Worker Adjustment and Retraining Notification ("WARN") Act. We contend TSC Group, LLC ordered mass layoffs at the company's facilities in Charlotte, North Carolina and Rock Island, Illinois, from about November 15, 2011 to about January 23, 2012 without providing the employees with advance written notice. The case is pending in the U.S. District Court for the Central District of Illinois.

On February 13, 2012, TSC Global filed for Chapter 11 bankruptcy protection in the United States Bankruptcy Court for the District of Delaware. On February 15, 2012, Outten & Golden re-filed the WARN suit in that bankruptcy court, where the litigation is continuing.

Generally, the WARN Act requires companies to provide their employees with 60 days written notice in advance of a mass layoff or plant closing. In the absence of such notice, employers may be liable to each affected employee for 60 days wages and benefits.
